<p>What does one do in honor of World Intellectual Property Day? For most people the response is to say “wait, it’s World Intellectual Property Day?” shrug, and then go back to other matters (like downloading intellectual property). But if you are US Representative Bob Goodlatte (R-Va.), and you chair the House Judiciary Committee, well, you might celebrate with a bit more pomp! Especially, if that means that you are delivering remarks at the Library of Congress.</p>
<p>So what did Representative Goodlatte say? And, more importantly, did he say it at a proper volume so that it could be heard by all without him risking being shushed by a librarian? Luckily the text of his comments was made available in a press release (no shushing necessary) with the easily understandable title of “<a href="http://judiciary.house.gov/news/2013/04242013_2.html" target="_blank">Chairman Goodlatte Announces Comprehensive Review of Copyright Law.</a>”</p>
<p>After opening his remarks with some light humorous patter (the revision of the copyright law in 1909 was to make it applicable to motion pictures [hilarious {you had to be there (I mean in 1909)}]), Goodlatte goes on to explain that copyright law has not exactly kept pace with the changes in the technologically enhanced dissemination of copyrighted material.  Example please (bonus points if you couch it in a reference to the founders)! Luckily Goodlatte obliges:</p>
<blockquote><p>“Our Founding Fathers could never have imagined a day in which citizens would be able to immediately access the knowledge and news of the world on their smartphones as they walk down the street.&#8221;</p></blockquote>
<p>This is a fair point, it may also be a fair point that “our Founding Fathers” might “never have imagined” assault rifles or ballooning student debt or climate change or Star Trek or People magazine, but I digress. Back to you Representative Goodlatte:</p>
<blockquote><p>“The Internet has enabled copyright owners to make available their works to consumers around the world, but has also enabled others to do so without any compensation for copyright owners.  Efforts to digitize our history so that all have access to it face questions about copyright ownership by those who are hard, if not impossible, to locate. There are concerns about statutory license and damage mechanisms. Federal judges are forced to make decisions using laws that are difficult to apply today. Even the Copyright Office itself faces challenges in meeting the growing needs of its customers – the American public.&#8221;</p></blockquote>
<p>The solution, as should be expected from the Chairman of the House Judiciary Committee, is to announce:</p>
<blockquote><p>“that the House Judiciary Committee will hold a comprehensive series of hearings on U.S. copyright law in the months ahead. The goal of these hearings will be to determine whether the laws are still working in the digital age. I welcome all interested parties to submit their views and concerns to the Committee.”</p></blockquote>
<p>Let us start by stating the obvious: contemporary copyright laws are a mess, and they do need to be revisited for the current age. The number of works (particularly audio works) that may disappear because nobody is sure who the copyright holder is (and therefore authorized to approve digitization/conservation) is staggering. Most people seem rather befuddled by much of the tangle that is copyright law (I say this as somebody who explains what “Fair Use” means on a daily basis). And something does need to be done to give cultural creators better means of controlling the dissemination of their work (though there are certainly solutions other than tighter copyright laws).</p>
<p>In other words Representative Goodlatte’s basic insight is correct: copyright laws need to be updated. Librarians (and many others) have been saying that for years.</p>
<p>Yet this announcement should cause as much pause as optimism, if not more pause than optimism. Copyright law needs to be adjusted, but whose interests are going to be focused upon in the revamping of these laws? Will strengthening the public domain be the focus? Shall Creative Commons be used as an example? Or will this be a stealth way of executing many of the policies that have caused uproar from many groups of late? Does Goodlatte mean it when he welcomes “all interested parties?” Before you answer consider the following…</p>
<p>Representative Goodlatte was one of the original sponsors and coauthors of the Stop Online Piracy Act (SOPA), and as should come as no surprise he was one of the Representatives who helped CISPA to pass the House (<a href="https://librarianshipwreck.wordpress.com/2013/04/22/while-we-were-distracted-cispa-passed-in-the-house/" target="_blank">just last week</a> [he cosponsored CISPA the first time around]). So what direction might his copyright review take? And whose opinions shall he solicit?</p>
<p>In the “<a href="http://goodlatte.house.gov/pages/technology" target="_blank">Technology and Innovation</a>” section of <a href="http://goodlatte.house.gov/" target="_blank">Representative Goodlatte’s website </a>are the following helpful sentences:</p>
<blockquote><p>“I support efforts to enforce our nation’s intellectual property laws to ensure that those who steal the intellectual property of others are prosecuted.  I also believe that technology can provide some of the most effective solutions to help protect intellectual property.”</p></blockquote>
<p>Those do not seem to be the statements of somebody with a goal of broadening copyright to allow a more relaxed understanding of Fair Use (and other) policies. Rather they seem to be the words of somebody who wants to see SOPA or CISPA or whatever it’s going to be called, pass under the seemingly friendly guise of “copyright reform.” After all, he says “prosecuted” not “preserved” for the ages, or better yet, “shared.” Thus the challenge falls to those of us who would like to see copyright updated to benefit the public (and creators [as opposed to just those who hire creators]) to ensure that copyright reform is reform and not regression.</p>
<p>Copyright laws in the US need to be reformed, they need to be reformed badly; however, they need to be reformed in a way that benefits the public instead of in a way that simply ensures that a cartoon mouse thought up by a long dead anti-Semite never enters the public domain. And they need to be updated in a way that won’t result in you being prosecuted for making a mash-up video featuring Representative Goodlatte and an advertisement for where you can obtain a good latte.</p>
<p>True, all that has been announced so far is Goodlatte’s intention to review copyright laws but this is a conversation that we need to engage with at the outset instead of launching a campaign when the bill is already being voted on.</p>
<p>Do you want <a href="http://www.wipo.int/about-wipo/en/" target="_blank">World Intellectual Property Day</a> (which is actually the 26th) to be about the World, or do you just want it to be about property? Alas, I think we know how Representative Goodlatte answers that question.</p>

<p><strong>Shawna Gillen</strong> blogging at <strong>Policymic.com</strong> grudgingly predicts a precedent has been set here: &#8221;While the NYPD and Brookfield had a strong case to justify taking control of the park, they certainly took a cop out strategy to avoid even more fees. <p><strong>Business Insider</strong>&#8216;s <strong>Michael Kelley</strong> reports quite accurately on the raid and destruction of the library &#8220;Around 1 a.m. on Nov. 15, 2011, Mayor Michael R. Bloomberg ordered the NYPD to evict protestors — some of whom had camped there for almost two months — from Zuccotti Park in New York City&#8217;s Financial District. The police threw away 5,554 books from the Occupy library and destroyed media equipment in addition to removing tents, tarps, and belongings.&#8221;&#8230;and even better, Business Insider refers to the movement, quite correctly, in the present tense &#8220;Occupy Wall Street is a movement, beginning on September 17, 2011 in Liberty Square, that protests the role of Wall Street in the 2007 financial crisis and aims to resist the influence of major banks and multinational corporations.&#8221; <a href="http://www.businessinsider.com/city-to-pay-365000-for-occupy-library-2013-4" target="_blank">read more&#8230;</a></p>

<p>The <strong>Daily News</strong> chose to show off Steve&#8217;s smiling face and sounds surprised that a collection of graduate students, writers, artists, seasoned activists and librarians was able to work with a skilled civil rights attorney to win this case&#8230; as they report &#8220;Remember the anti-authority message of Occupy Wall Street? Remember the backlash over its vague goals and nebulous methods? Surprise! <p>This opinion piece on <strong>Gather</strong> gets at least, and perhaps only, one thing right when they refer to the Occupy movement as &#8220;radical&#8221; and &#8220;anti-capitalist.&#8221; The rest of it distorts the facts or just makes things up such as &#8220;The police even stored the books for pick-up.&#8221; Well&#8230;. actually the books that weren&#8217;t destroyed were sent to a sanitation garage, not held by the police, and the tweet from the mayor&#8217;s office was nothing more than a PR stunt because they were losing the image game in the press. This article also ignores the fact that Bloomberg&#8217;s office did not preserve any books or make them available (although they lied on twitter and said they had), because most of them had been thrown away or destroyed &#8211; as the city clearly admits in the settlement. <a href="http://news.gather.com/viewArticle.action?articleId=281474981868239" target="_blank">read more&#8230;.(although it&#8217;s really not worth reading)</a></p>

The raid was launched on November 15, 2011 when Mayor Michael Bloomberg ordered the police to evict protesters at Zuccotti Park.&#8221; <a href="http://www.inquisitr.com/612069/nypds-occupy-wall-street-raid-costs-city-366000/" target="_blank">read more&#8230;</a></p>

<p><strong>msn.com</strong> mentions the police brutality charges brought by journalists who were stopped from covering the violent eviction writing &#8220;Occupy Wall Street hasn&#8217;t scaled the same heights of publicity it had in 2011, but at least one NYC organization is still feeling heat from the group. That would be the NYPD, whose (some would say heavy-handed) November 2011 raid on the group&#8217;s Zuccotti Park encampment is going to cost them $366,700 in settlement money, according to a recent court ruling. That figure covers the destruction of books, computer equipment and bicycle-powered generators the group was using. What of the brutality charges levied against the NYPD by journalists arrested while trying to cover the raid? That&#8217;s covered in a separate lawsuit. <p>The <strong>New York Times</strong> opens with &#8220;As myriad court battles pitting the Occupy Wall Street movement against New York City agencies proceed, protesters claimed a victory on Tuesday, based not on how they were treated, but on how their books were mistreated.&#8221; <a href="http://www.nytimes.com/2013/04/10/nyregion/occupy-wall-street-wins-suit-over-seizure-of-library.html?_r=1&amp;" target="_blank">read more&#8230;</a></p>
<p><strong>The Atlantic</strong> reports &#8220;Fans of justice will be glad to hear that New York City will pay for all those books and all that media equipment that the police trashed when it famously raided the Occupy Wall Street camp on November 15, 2011.&#8221; <a href="http://www.theatlanticwire.com/national/2013/04/new-york-city-has-fork-over-365000-its-destructive-raid-zucotti-park/64062/" target="_blank">read more&#8230;</a></p>

January 18, 2013 – March 30, 2013</p>

<p>Brother, Can You Spare a Stack presents thirteen art projects that re-imagine the library as a force for social change. Each project constructs a micro library of sorts that serves specific economic or social needs within the community. Each project proposes an alternative politicized realm, which can be imagined and formed to explore the social dimensions of contemporary culture. Small and mobile, these projects resist the limitations of a controlled, highly organized system that governs our society. In contrast to subjective libraries formed by the artists picking and choosing book titles, these projects take a pragmatic and rational approach, using the library model as an interactive field. Selected projects update the principles of relational aesthetics, and shift them towards all-inclusive and useful cultural production. “Brother, Can You Spare a Stack” borrows its title from the lyrics of a popular depression era song, claiming that the artists invent alternative models of questioning, inspiring new perspectives on social transformation. They insert themselves into the most unexpected situations and spaces, in this case libraries, to propose social and cultural improvement. The exhibition includes projects by: Arlen Austin and Jason Boughton; Brett Bloom and Bonnie Fortune; Stephen Boyer; BroLab (Rahul Alexander, Jonathan Brand, Adam Brent, Ryan Roa, and Travis LeRoy Southworth); Valentina Curandi and Nathaniel Katz; Finishing School with Christy Thomas; Anna Lise Jensen and Michael Wilson; Jen Kennedy and Liz Linden; The K.I.D.S. with Word Up Collective, Eyelevel BQE, Launchpad, NURTUREart, Weeksville Heritage Center, and individual partners, as well as with Emcee C.M., Master of None; Annabel Other; Reanimation Library; The Sketchbook Project; and Micki Watanabe Spiller. </p>

<p style="text-align:justify;">For those looking to help in the recovery after Hurricane Sandy, here are a list of resources. I&#8217;ve worked with the Red Cross disaster relief operations here as well as doing social media work to promote Occupy Sandy so feel free to post questions about the aid situation on the ground. The most important thing to know is that the best way to direct your time, donations or resources are where they are needed. You might be tempted to put some canned food together or some clothing and bring it to an affected area, but that often causes more challenges for relief work. Instead, look carefully at what is needed and contribute based on need. If you want to donate goods, keep in mind that organizations like Red Cross do not accept such donations, the Occupy Sandy web site has many lists of donation drop offs. <p>In a day or two when we start to clean up, look to your local libraries &#8212; especially in New Jersey&#8217;s coastal towns, things are really getting torn up, and they might need some hands or some cash to help recover.</p>

<blockquote><p>Goldman Sachs Group, Inc. is a multinational investment bank founded in 1869 and headquartered at 200 West Street in Lower Manhattan. Leading up to the 2008 financial crisis, Goldman Sachs engaged in some of the worse financial fraud the world has ever seen, including packaging and selling billions of dollars in subprime housing derivatives and other worthless securities to small and mid-level investors while hiding the fact that they were simultaneously betting against these same securities. Through such fraud Goldman Sachs decimated the 401(k)s, pensions and mutual funds of thousands of Americans.</p>
<p>Despite blatantly vilating the Securities Act of 1933, which &#8220;prohibits deceit, misrepresentation, and other fraud in the sale of securities,&#8221; and despite a 650-page Senate subcommittee investigation report accusing them of defrauding clients, not a single official of Goldman Sachs has been prosecuted. Rather, the corporation was rewarded, receiving more government bailout funds than any other investment bank. Goldman Sachs then used this taxpayer money to give its senior executives a staggering $44 billion in mega-bonuses between 2008 and 2011.</p>
<p>While Goldman Sachs CEO Lloyd Blankfein makes an estimated $250,000 a day, regular Americans are losing their jobs and homes at the highest rate since the 1930s. The real unemployment rate (in 2012) is almost twenty percent, far higher than the official number of nine percent, which intentionally factors out workers who have exhausted their unemployment benefits and those working temporary or part time jobs. The so-called &#8220;jobless recovery&#8221; means that speculators like Lloyd Blankfein can get richer even during a recession. As one private trader, Alessio Rastani, candidly told the BBC in Fall of 2011, &#8220;Most traders don&#8217;t really care about fixing the economy. If you know what to do, if you have the right plan set up, you can make a lot of money from this [recession].&#8221; He continued with another dose of frank cynicism, &#8220;This is not a time right now for wishful thinking that governments are going to sort things out. Governments don&#8217;t rule the world. Goldman Sachs rules the world.&#8221;</p></blockquote>

<p style="text-align:justify;">I&#8217;ve wanted to mark the recent <a href="http://pcp.gc.cuny.edu/2012/09/neil-r-smith-1954-2012/" target="_blank">sudden and tragic death</a> of radical geographer <a href="http://en.wikipedia.org/wiki/Neil_Smith_(geographer)" target="_blank">Neil Smith</a>, but wasn&#8217;t sure quite how. Just now, as I was re-reading his book &#8220;The New Urban Frontier: Gentrification and the Revanchist City&#8221; I realized that I could do this in two ways. First by sharing some passages from the first chapter, which contains an account of the eviction of the Tompkins Square Park occupation in 1988 (and again in 1991) echoing the eviction from Liberty Plaza of the Occupy Wall Street encampment, and second by sharing <a href="https://courses.arch.ntua.gr/fsr/135200/the-new-urban-frontier-neil-smith.pdf" target="_blank">a link to the entire book</a> in PDF form, which is available free online from the National Technical University (NTUA) in Athens.</p>

<p style="text-align:justify;">Neil Smith&#8217;s account of the occupation and eviction, as well as his analysis of urban class struggle are vital texts for occupiers to understand the history of resistance in the city. For those who haven&#8217;t read them, or aren&#8217;t familiar with the occupation of Tompkins Square, they will be eye-opening:</p>

<p style="text-align:justify;">On the evening of August 6, 1988, a riot erupted along the edges of  Tompkins Square Park, a small green in New York City&#8217;s Lower East Side. It raged through the night with police on one side and a diverse mix of anti-gentrification protesters, punks, housing activists, park inhabitants, artists, Saturday night revelers and Lower East Side residents on the other. The battle followed the city&#8217;s attempt to enforce a 1:00 A.M. curfew in the Park on the pretext of clearing out the growing numbers of homeless people living or sleeping there, kids playing boom boxes late into the night, buyers and sellers of drugs using it for business. But many local residents and park users saw the action differently. The City was seeking to tame and domesticate the park to facilitate the already rampant gentrification on the Lower East Side . . .&#8221;Whose fucking park? It&#8217;s our fucking park,&#8221; became the recurrent slogan . . .</p>

Clad in space-alien riot gear and concealing their badge numbers, the police forcibly evicted everyone from the park before midnight, then mounted repeated baton charges and &#8220;Cossacklike&#8221; rampages against demonstrators and locals along the park&#8217;s edge:</p>
<p style="padding-left:30px;text-align:justify;">&#8216;The cops seemed bizarrely out of control, levitating with some hatred I didn&#8217;t understand. They&#8217;d taken a relatively small protest and fanned it out over the neighborhood, inflaming hundreds of people who&#8217;d never gone near the park to begin with. They&#8217;d called in a chopper. And they would eventually call 450 officers&#8230; The policemen were radiating hysteria . . .&#8217; (Carr 1988:10)</p>

<p style="text-align:justify;">. . .In the days following the riot, the protesters quickly adopted a much more ambitious political geography of revolt. Their slogan became &#8220;Tompkins Square everywhere&#8221; as they taunted the police and celebrated their liberation of the park. Mayor Edward Koch, meanwhile, took to describing Tompkins Square Park as a &#8220;cesspool&#8221; and blamed the riot on &#8220;anarchists.&#8221; Defending his police clients, the president of the Patrolmen&#8217;s Benevolent Association enthusiastically elaborated: &#8220;social parasites, druggies, skinheads and communists&#8221; &#8211;an &#8220;insipid conglomeration of human misfits&#8221; &#8211;were the cause of the riot, he said. . .</p>

				<content:encoded><![CDATA[<p>Listen up, kids, this is important!  Today we&#8217;re going to talk about grand juries.  With a side of intellectual freedom.</p>
<p>Look, we&#8217;ve got three people &#8212; Matt Duran, Kteeo (Katherine Olejnik), and Leah-Lynn Plante &#8212; <a title="locked up" href="http://www.greenisthenewred.com/blog/3-young-people-now-in-jail-for-refusing-to-talk-about-other-anarchists/6467/">locked up for contempt</a> out in Seattle, WA.  They&#8217;ve all refused to testify before a grand jury.</p>
<p><a title="Grand juries" href="http://en.wikipedia.org/wiki/Grand_juries_in_the_United_States">Grand juries</a> are one of the government&#8217;s shittiest tools for squishing dissent.  They were originally intended as a way for individual citizens to bring a matter before their peers to make the government do something about it.  Today, though, they are a way for the government to intimidate and punish people who make noise, without those people having any recourse.  Folks get hauled into court, without having been accused of anything, and are asked a bunch of questions.  They are not allowed to have an attorney with them, and the room is closed and what goes on is kept secret.  They must answer the questions &#8212; the 5th Amendment, which otherwise protects us from having to testify against ourselves, does not apply.  If they refuse to testify &#8212; a choice that is usually a good idea in cases of political repression &#8212; they may be jailed for up to six months for contempt, in order to coerce testimony.  If after six months a person has not spoken, they can be sent back for another six months, et cetera, et cetera, until someone gives up.  Remember, these folks have not even been accused, let alone convicted, of a crime in the first place.  The point of a grand jury is for the government to figure out if there&#8217;s anything floating around that they can prosecute someone for.</p>
<p>Back on July 25, if you&#8217;ll recall, Plante and Duran were a couple of the folks in Oregon and Washington states who woke up to the early morning sounds of their doors being smashed in by federal officers.  Their residences were searched by feds looking for, among other things, black clothes and anarchist literature.  Yesterday, before Plante went back before the grand jury and again refused to testify, <a title="she wrote" href="http://leahxvx.tumblr.com/post/33298924637">she wrote</a>:</p>
<blockquote><p>On the morning of July 25th, 2012, my life was turned upside down in a matter of hours. FBI agents from around Washington and Oregon and Joint Terrorism Task Force agents from Washington busted down the front door of my house with a battering ram, handcuffed my house mates and me at gunpoint, and held us hostage in our backyard while they read us a search warrant and ransacked our home. They said it was in connection to May Day vandalism that occurred in Seattle, Washington earlier this year.</p>
<p>However, we suspected that this was not really about broken windows. As if they had taken pointers from Orwell’s 1984, they took books, artwork and other various literature as “evidence” as well as many other personal belongings even though they seemed to know that nobody there was even in Seattle on May Day. While we know that knowledge is powerful, we suspected that nobody used rolled up copies of the Stumptown Wobbly to commit property damage. We saw this for what it was. They are trying to investigate anarchists and persecute them for their beliefs. This is a fishing expedition. This is a witch hunt. Since then, thanks to a Freedom of Information Act request, we have learned that this Grand jury was convened on March 2nd, 2012, two months before the May Day vandalism even took place…</p></blockquote>
<p>As predicted, she was locked up after yesterday&#8217;s grand jury session.  Matt has been imprisoned since September 13, including time in solitary confinement, and Kteeo since September 28.  So, shit&#8217;s scary.  But, we&#8217;re all in this together, and the best way to handle this is for us all to create and maintain a loving community and to take care of each other.  Which is what grand jury resisters are doing, by they way &#8212; they are taking a hit for the rest of us.  We should all be supporting these three, in word and deed, as much as we can, since they&#8217;re going so hard to protect our asses.  <a title="stuff" href="http://anarchistnews.org/content/how-you-can-help-northwest-grand-jury-resistors">Here&#8217;s some stuff</a> you can do for Matt and Kteeo, and I&#8217;m sure there&#8217;ll be a similar round up for Leah shortly.</p>
<p>So, this is the Library blog, right?  Let&#8217;s bring it back home.  See up there where Leah writes about her house being searched?  What did the feds take?  Books, art.  As many folks around the internet have noted, if the FBI came gunning into any of our houses they&#8217;d find black clothing and subversive literature.</p>
<p>Yo, feds, Senator McCarthy called, he wants his game plan back.</p>
<p>Aside from the 5th Amendment mentioned above, we are also supposed to be guaranteed rights of speech and press under the 1st Amendment, and the rights to free speech and assembly include freedom of association, as clarified by Supreme Court rulings.  Now, I know some of us don&#8217;t truck with the idea of rights (Utah says, “The state can&#8217;t give you freedom, and the state can&#8217;t take it away. You&#8217;re born with it, like your eyes, like your ears. Freedom is something you assume, then you wait for someone to try to take it away. The degree to which you resist is the degree to which you are free.”), but it&#8217;s what we&#8217;ve got to work with right now.</p>
<p>And yet we have doors being busted down over books, and the printed word being taken away as evidence of&#8230;  &#8230;something.  That our three grand jury resisters hold certain political opinions, and know others with similar opinions, is enough to have gotten them into this spot in the first place.  Librarians, our professional association <a title="a lot to say" href="http://www.ala.org/advocacy/intfreedom">has a lot to say</a> about the 1st Amendment.</p>
<p>We&#8217;ve just come off of <a title="Banned Books Week" href="http://bannedbooksweek.org/">Banned Books Week</a>.  I hope you read something subversive!  I always hope that, actually.  I also hope that I don&#8217;t need to be too heavy-handed in drawing the lines between the FBI searching someone&#8217;s house for radical literature and the stuff we usually talk about when we talk about banned books.  It is a matter of degree, rather than kind.</p>
